Defense Secretary Pete Hegseth has officially censured Senator Mark Kelly over a controversial video that urged U.S. military personnel to refuse unlawful orders.
Hegseth’s censure, announced Monday, accuses the Arizona senator—a retired Navy captain—of “conduct seditious in nature.” The video in question, released last November, featured Kelly and other Democrats advising service members on their rights to reject unlawful commands. However, Hegseth contends that Kelly went beyond legal education and specifically counseled troops to refuse lawful orders, undermining military discipline.
The administrative censure, a formal reprimand less severe than a court-martial, will result in a reduction of Kelly’s rank and retirement pay. The process is expected to take 45 days. Experts note that pursuing a court-martial might have raised complex constitutional questions, making the censure a more straightforward path.
In his letter to Senator Kelly, Hegseth accused him of sowing confusion within the ranks, damaging the chain of command, and bringing discredit to the armed forces. The letter also warns Kelly that his status as a sitting U.S. Senator does not grant immunity from accountability, and further misconduct could lead to criminal charges or additional administrative actions.
Senator Kelly and the other Democrats featured in the video have pushed back, defending their message as consistent with the Uniform Code of Military Justice and constitutional rights. The video sparked sharp criticism from former President Donald Trump, who labeled it “seditious behavior” and called for the involved Democrats—many of whom have military or intelligence backgrounds—to face jail time.
At the time, the Pentagon launched a comprehensive review into Kelly’s actions. Kelly responded firmly, vowing not to be intimidated by the administration’s moves.
Today, Senator Kelly reaffirmed his intention to fight the censure. In a lengthy statement, he criticized Secretary Hegseth as “the most unqualified Secretary of Defense in our country’s history” and condemned the censure as an attempt to silence retired service members.
Kelly declared, “I will fight this with everything I’ve got—not for myself, but to send a message that Pete Hegseth and Donald Trump don’t get to decide what Americans get to say about their government.”
